Please read these Terms of Service (“Agreement” or “Terms”) carefully before using www.theigt.com (the “Site”) operated by Icegiant Collective LLC, doing business as ICEGIANT / theigt (“ICEGIANT,” “theigt,” “we,” “us,” or “our”).

By accessing or using the Site in any manner, including visiting, browsing, creating an account, placing an order, submitting content, or purchasing products from the Site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase products from us.

1. General Terms

These Terms apply to your use of the Site and to all products and services purchased through the Site.

These Terms, and any rights and licenses granted under them, may not be transferred or assigned by you without our prior written consent. We may assign or transfer these Terms without restriction.

We reserve the right to refuse service, cancel orders, limit quantities, or discontinue products at any time, subject to applicable law.

2. Site Use and Account Registration

Some features of the Site may require account registration. By creating an account, you agree to provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You may not use the Site for any unlawful, fraudulent, harmful, abusive, or unauthorized purpose. You may not interfere with the operation, security, or integrity of the Site.

You are not permitted to frame this Site, copy substantial portions of the Site, or use our proprietary marks, images, videos, designs, or content without our prior written consent.

3. Product Information and Handcrafted Disclaimer

We offer a mix of ready-to-ship, made-to-order, and custom-made jewelry products. Custom products may be based on your selected options, design details, size, metal type, stone quality, mold, fit information, photos, videos, or other specifications.

Due to the handcrafted and customized nature of certain products, slight variations in craftsmanship, color, texture, stone placement, finish, size, and appearance may occur between the product images shown on the Site and the actual item you receive. These variations are not considered defects unless they materially differ from the approved order details or confirmed specifications.

We make reasonable efforts to display product colors, materials, and attributes accurately. However, we cannot guarantee that your device or monitor will display colors exactly as they appear in person.

All specifications, product descriptions, materials, availability, and prices are subject to change at any time without notice.

4. Product Types and Custom Orders

Some products on the Site are ready-to-ship items, while others are made-to-order or custom-made based on your selected options, design details, sizing, mold, fit information, or other specifications.

For custom-made products, including custom grillz, production may begin only after the required design details, mold, fit information, CAD, mock-up, or other required order information has been reviewed or approved.

Because custom products are made specifically for you, cancellations, returns, refunds, exchanges, repairs, or remakes may be subject to additional restrictions as described in our Return, Refund, Remake, and Repair Policy.

You are responsible for providing accurate order details, design instructions, sizing information, shipping information, mold materials, photos, videos, or other information required for production.

Delays, fit issues, remake requests, or additional costs may occur if the information you provide is incomplete, inaccurate, delayed, or unsuitable for production.

5. Custom Grillz and Mold Kit Terms

ICEGIANT custom grillz are removable decorative oral jewelry items. They are not dental treatment, orthodontic devices, dental prosthetics, medical devices, or substitutes for professional dental care.

ICEGIANT does not provide dental diagnosis, dental treatment, orthodontic services, oral health assessments, medical advice, or any dental or medical procedure.

The mold kit is provided only for customers to submit fit information for custom decorative jewelry production.

Unless expressly stated otherwise, the customer is responsible for completing the mold-taking process. ICEGIANT does not directly supervise, perform, or provide in-person guidance for the customer’s molding process.

If you are unsure whether you should use a mold kit or wear custom grillz, you should consult a licensed dental professional before ordering or using the product.

Customers with braces, retainers, implants, loose teeth, gum disease, oral pain, allergies, recent dental treatment, or any dental or oral health concerns should consult a licensed dental professional before ordering or wearing custom grillz.

6. Safety and Use of Custom Grillz

Custom grillz should be used responsibly and only as removable decorative oral jewelry.

Do not wear grillz while eating, sleeping, exercising, or if the product feels loose, uncomfortable, or unsafe.
Do not use glue, dental adhesive, or any other substance to attach grillz to your teeth.
Do not modify, bend, grind, force, or adjust grillz on your own. Improper use, modification, poor fit, or failure to follow care instructions may increase the risk of discomfort, irritation, damage, injury, or product failure.
If you experience pain, bleeding, gum irritation, allergic reaction, looseness, choking risk, swallowing risk, or any discomfort, stop wearing the grillz immediately and consult a licensed dental professional.

7. Pricing, Payment, and Taxes

All prices listed on the Site are in United States Dollars (USD) unless otherwise stated.

We strive to provide accurate pricing information, but errors may occur. We reserve the right to correct any pricing errors, product description errors, or availability errors at any time, including after an order has been placed.

We may cancel or refuse any order placed based on an incorrect price, incorrect product description, suspected fraud, payment issue, or other order concern.

Prices displayed on the Site do not include sales tax unless expressly stated. For orders shipped within the United States, applicable sales tax may be calculated and added at checkout based on your shipping destination and applicable state or local tax laws.

For orders shipped outside the United States, the customer is responsible for any import duties, taxes, VAT, GST, customs fees, brokerage fees, or other charges imposed by the destination country. These charges are not included in our product prices or shipping fees unless expressly stated. We do not control these charges and cannot predict the amount.

By placing an order, you agree to pay all applicable charges, including product price, shipping fees, taxes, duties, and any other applicable fees.

8. Shipping Information

Shipping times, delivery estimates, carriers, and shipping fees may vary depending on the product type, customization process, destination, shipping method, and order status.

For custom products, production time does not begin until all required order details, mold materials, fit information, design approvals, or other required information have been received and reviewed.

Shipping estimates are not guaranteed unless expressly stated. We are not responsible for delays caused by customs, carriers, incorrect shipping information, weather, holidays, third-party service providers, or events outside our reasonable control.

9. Refunds, Returns, Remakes, and Repairs

All cancellations, returns, refunds, exchanges, repairs, and remake requests are subject to our Return, Refund, Remake, and Repair Policy.

Custom-made products, including custom grillz, may not be eligible for cancellation, return, refund, or exchange once design work, mold review, CAD work, production preparation, or manufacturing has started, except where required by applicable law or where a confirmed production defect exists.

Deposits may become non-refundable after a design, mock-up, CAD, mold review, or production preparation has been provided.

If there is a confirmed production defect, material error, or mismatch from the approved order details, we may offer a repair, remake, refund, or other appropriate solution after review.

Fit-related concerns for custom grillz must be supported with clear photos, videos, and a description of the issue. Each case will be reviewed based on mold quality, approved design details, production records, and submitted evidence.

Nothing in these Terms limits any mandatory consumer rights that may apply under applicable law.

10. Accuracy, Completeness, and Errors

We strive to ensure that information on the Site is complete, accurate, and current. However, information on the Site may occasionally be inaccurate, incomplete, or out of date.

We reserve the right to correct errors, inaccuracies, or omissions, and to change or update information at any time without prior notice, including after you have submitted an order.

We also reserve the right to cancel or refuse orders if any information on the Site or related services is inaccurate, incomplete, or unavailable.

11. User-Submitted Materials

You are responsible for any materials you submit to us or upload through the Site, including text, images, videos, design references, measurements, mold photos, product preferences, reviews, feedback, and other content.

You represent that any materials you submit are accurate, lawful, original, and do not infringe the rights of any third party.

By submitting materials to us, you grant ICEGIANT a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, store, display, and process those materials as reasonably necessary to provide products, process orders, offer customer support, improve services, and operate our business.

You may not submit content that is illegal, harmful, misleading, abusive, defamatory, obscene, infringing, or otherwise inappropriate.

12. Intellectual Property

The Site and its original content, including but not limited to text, graphics, images, videos, product designs, logos, trademarks, icons, layout, functionality, and software, are owned by or licensed to ICEGIANT and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, display, sell, resell, or exploit any portion of the Site or our content without our prior written permission.

All ICEGIANT / theigt names, logos, product names, images, and brand assets are proprietary to us or our licensors.

13. Third-Party Content and Services

Certain content, features, payment options, financing options, applications, links, or services available through the Site may be owned, operated, or provided by third parties.

Your use of third-party services may be subject to separate terms, conditions, privacy policies, and fees.

ICEGIANT is not responsible for, and does not control, third-party content, websites, applications, payment providers, financing providers, shipping carriers, or service providers.

The Site may contain links to third-party websites. These links are provided for convenience only.

We are not responsible for the content, privacy practices, terms, or actions of any third-party websites. We encourage you to review the policies of any third-party website you visit.

15. Warranty Disclaimer

Except as expressly stated in our product descriptions or applicable policies, the Site and products are provided to the fullest extent permitted by applicable law without warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

Nothing in these Terms is intended to limit rights that cannot be excluded under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain warranties, so some of the above exclusions may not apply to you.

16. Limitation of Liability

By placing an order, you agree that your use of the Site and purchase or use of our products are at your own risk, subject to applicable law.

To the fullest extent permitted by applicable law, ICEGIANT, theigt, Icegiant Collective LLC, and our directors, employees, partners, agents, suppliers, affiliates, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, data, use, goodwill, business opportunity, or other intangible losses arising from or relating to your use of the Site, purchase of products, use of products, inability to use products, or reliance on information available through the Site.

To the fullest extent permitted by applicable law, our aggregate liability for all claims related to a product purchased from the Site shall not exceed the actual amount paid by you for the product that gave rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

17. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ICEGIANT, theigt, Icegiant Collective LLC, and our directors, employees, partners, agents, suppliers, affiliates, contractors, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to:

your use or misuse of the Site;
your violation of these Terms;
your violation of any law or third-party right;
inaccurate, incomplete, or misleading information you provide;
unauthorized modification, misuse, or improper use of our products;
content or materials you submit to us.

18. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms or used the Site in an improper, unlawful, or harmful manner. All provisions of these Terms that by their nature should survive termination will remain in effect, including ownership provisions, warranty disclaimers, limitations of liability, indemnification, dispute resolution, and payment obligations.

19. Modifications to the Terms

We reserve the right to modify, update, or replace these Terms at any time by posting the updated Terms on the Site. Your continued use of the Site after any changes are posted constitutes your acceptance of the updated Terms.

20. Arbitration and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased through the Site will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except where prohibited by applicable law.

The arbitration will take place at a location mutually agreed upon by the parties, or as otherwise required by applicable law. The decision of the arbitrator will be final and binding.

Nothing in this section prevents either party from seeking relief in small claims court where permitted by applicable law.

Nothing in these Terms limits any rights that cannot be waived under applicable law.

21. Entire Agreement and Severability

These Terms, together with any policies referenced on the Site, including our Shipping Information, Return, Refund, Remake, and Repair Policy, and Privacy Policy, constitute the entire agreement between you and ICEGIANT regarding your use of the Site and purchase of products from the Site.

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

22. Copyright and Trademark Notices

ICEGIANT, theigt, and related names, logos, product images, designs, and brand assets are owned by or licensed to Icegiant Collective LLC and may not be used without prior written permission.
